Complying with the Data Protection Act (2008)

For studios operating in the United Kingdom, it's important to be aware of the regulations around Email and SMS marketing.

The following does not constitute legal advice. Please contact a lawyer if you have specific questions about complying with regulations.

The UK's Data protection Act (2008) states that, in order to send any electronic marketing, you must either have:

  • Their express, specific permission or

  • The lead or customer has provided their detail in the context of inquiring about a product or service

As well as the above, you also need to include a simple opt out function.
